Terms of Service

These Terms of Service ("Terms") govern your use of this website and your purchase of products from The Wellnest Haven, a store operated by PTY UNLIMITED PTY LTD (ABN 98 693 284 525) ("we", "us", "our"). By placing an order, you agree to these Terms.

Orders & pre-orders

• Placing an order is an offer to buy. Your order is accepted when we confirm it by email.
• Pre-orders / reservations: stock is made in limited monthly runs. When you reserve, we take full payment to secure your unit, and your order is expected to ship by the end of July 2026. If a significant delay arises, we will let you know and you may wait or receive a full refund.
• We may cancel and fully refund an order if a product is unavailable or if there has been a pricing or description error.

Pricing & payment

• All prices are in Australian dollars (AUD) and include GST.
• Payment is required in full at checkout. We do not offer instalment plans or subscriptions.
• Payments are processed securely by our payment providers; we do not store your full card details.

Delivery, title & risk

We offer free standard shipping across Australia. Title to and risk in the goods passes to you on delivery to the address you provide. Delivery timeframes are estimates; see our Shipping & Returns policy.

Warranty

Our products come with a two-year manufacturer's warranty covering defects in materials and workmanship under normal domestic use. This is in addition to your rights under the Australian Consumer Law. It does not cover damage from misuse, accident, unauthorised modification, or failure to follow care and maintenance instructions (including using distilled water as directed).

Your rights under the Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these Terms limits those rights.

Product information & health

Our product is a comfort and temperature-regulation device. It is not a medical device and is not intended to diagnose, treat, cure or prevent any medical condition. Any research we reference concerns cooling and sleep generally, not this specific product. Information on this site is general only and is not medical advice.

Intellectual property

All content on this website — text, images, logos and design — is owned by or licensed to us and may not be copied or used without our permission.

Limitation of liability

To the extent permitted by law, and subject to your rights under the Australian Consumer Law, our liability for any claim relating to a product is limited to replacing the product or supplying an equivalent, or paying the cost of doing so.

Governing law

These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts.
